sounds a bit silly to me: if game rules clearly says he MUST accept such a treaty, then why does he even have the choice to refuse rather than it being done automaticly????

There should be something like a "Right of Retreat" treaty. If the Admins have decided that it is wrong to block a player's troops in, then a treaty like that will mean that only the trapped troops are free to return home. This is often what would happen in conquered castles, the troops were disarmed and allowed to return peacefully to their homes.
